HI, MY NAME IS MONICA I HAVE A 10 YEAR DAUGHTER, WHOSE FATHER IS LIVING IN THE UNITED STATES 5 YEARS AGO, HE IS ALREADY A LEGAL RESIDENT AND I BELIEVE SOON TO BECOME A CITIZEN OF THE UNITED STATES. MY DAUGHTER WAS BORN IN COLOMBIA, I AM A COLOMBIAN, HE IS ONLY GIVING ME 100 DOLLAR A MONTH FOR CHILD SUPPORT, BUT IS NOT ENOUGH AS YOU WOULD KNOW IT. WHAT CAN I DO, DO I HAVE ANY KIND OF RIGHTS FOR THE FACT THAT HE IS LIVING AND WORKING LEGALLY IN THE UNITED STATES? DOES MY DAUGHTER HAS ANY KIND OF RIGHTS TO RECEIVE MORE EACH MONTH? PLEASE REPLY AS SOON AS YOU CAN.

I think that would have to be taken up with Columbian officials. The child doesn't live in the US, never has lived in the US, wasn't born in the US - all of which I assume. So I would not expect US laws to govern the child support your child might be entitled to. I personally think, and have no experience or law to back this up, that the fact that he works and lives in the US should have no bearing on how much CS is owed to a child living in another country. What do your laws say about child support?

Child support is determined by the courts where the child resides, regardless of the child's citizenship or either parent's citizenship. You would have to apply for support through the courts there, as well as set an amount due. If there is a reciprocal agreement with the US, the courts there could forward the order to the US courts. US courts could then enforce it.

You need to consult with an attorney in YOUR country.

Does he owe any arrears, or has he always paid on time. If Columbia can't help you get a decent increase in CS to an amount that is at least no longer laughable, and if your ex owes any arrears, I'd check with the US about having his citizenship revoked for past due support.

You can revoke a greencard, you can revoke a Visa or passport, but once citizenship is established in one country, it is ened in another country. So, if you revoked someones citizenship they would essentially be a person without a country, and would be unable to live anywhere accept the Artic or Antartic circles (which are claimed by no country).
