I know this is off topic. I have a question. Is the division of assets (the value) determined at the time that you are legally separated? When you are legally separated, any debt or assets occured are your responsibility right? And asset values are determined at time of legal separation (filed with court). Any answers would be great. Thanks.

It can vary...some use date of separation, some use date of filing.

Ok, the property is actually in North Caralina and was purchased AFTER the legal separation which was over 10 years ago! Could they really try to get half of this when they never paid anything on it, property not in his name, and was bought after legal separation.

If you have a legal separation...talking about an actual document that came from the courts...then the property is separate.

The divorce is not final but he thinks he is entitled to half of property that is not his.. The legal separation is filed with court.
