Several weeks ago, I made the pmt to catch up DH's CS and paid about $1K too much (Don't ask me HOW I made that error). Since the BM wasn't owed this money, they wouldn't release the funds to her and they will only release the funds to us after Indianapolis approves it. God only knows how long that will be. Anyway, I can wait for the money...that's NOT the problem.

The problem is that they are NOT releasing his weekly CS pmts to her, either. She's placed multiple calls (sometimes several times daily) to me and the CSO office trying to get someone to pay her. I really don't know what to do to fix this one, but man, do I ever want her to stop dialing my number?

Anyone ever deal with a situation like this? I mean, how do you make a gov't agency MOVE????



PERFECT example of WHY I pay directly..... .and it has nothing to do with me being "perfect" at all.... but just having some common sense!!

NOW.. of course.... there are the states that require you to go through the CSE or a State agency... but if you can avoid it.... I WOULD at all cost.......

There ARE time when it is safer to pay through an agency.

When my husband filed for the change of custody, his ex said that she has not recived ANY CS payments for a long time. It was up to my husband to prove that he DID pay. It was nice to just call the CSA and have them send an accounting of how my CS he paid (he was current) and who the payments were sent to (the paperwork said who it was sent to).

CSA DO have their downsides and problems. We also had one when my husband file to recieve CS. After he had to give the CSA the CO, someone mixed up the NCP and CP. The CSA sent a letter to my husband's work to garnish his wages for the amount that HE was to RECEIVE. Even the HR lady at my husband's work was AMAZED on how quick the CSA moved to correct that mistake. She had a fax (to stop ANY and ALL withholdings for CS) within a few hours after we notified the CSA of the "problem".

For accounting problem especially when the CP may decide to say they didn't recive any CS is priceless.

BTW, my husband did pay his ex directly right after they were divorce. He had his ex sign a recipt that she recieve that amount for CS. But she didn't tell welfare that she was reciving CS so they went after my husband. He had to repay the amount in question. So even with ALL of the problems he has had with the CSA, IMHO just having that accounting that the court will accept is priceless.

You can accomplish the same thing without an agency....

you set up a seperate account- this account is for the sole purpose of paying CS. You transfer the money over each month. You write the check. On the check, you write what month and purpose. CS, Jan 07. You send it too the CP... (in my case, I just deposit it). They deposit it. You have the check, you have online checking- you can pull info.... can they take you to court and say they didn't get it? Sure.... but they can do that with an agency too....There is nothing different.

OR.. through your OWN employer.. you can set up CS to be directly deposited out of your check to their account. You don't have to have an agency.... it's not "safer" as the OP stated.... you risk the same problems..but instead of relying on the agency and the gov't to do your work... you can get it done 1/2 as fast... and move on in life........

Some states do not allow you to NOT pay thru the state CSE. Because the more cases CSE has the more the federal funding.

I didn't add the part about why... but I did do the caveat that some states won't allow you to pay directly....

Ours is paid through the circuit clerks office in our county. The check is payable to BM, mailed to clerk's office where they record the fact that we paid, and then they put it in an envelope that day and mail it to BM. It's not 'their' money, the check is not payable to them, therefore they have no right, nor cause to 'hold' the money. They don't figure out whether the amount is correct, they don't calculate arrears, they don't enforce if payment isn't made, they don't try to decide whether the money is due to BM or if it's too much or not enough - they simply note that that a payment of $XXX was made on xx/xx/xxxx and forward the check to her. It costs us a whopping $1 per payment made (12 per year). Well worth the cost of having an impartial third party making notes of the payments you made, IMO.
