VEHICL E IN MY NAME

My husband and I are getting a divorce. He wants the truck but it is in my name only. It is brand new and has 5 years of payments left on it. He says he can't refinance because of his credit. Is there anything that I can do to protect myself? I won't be able to get credit for anything because of my debt to income ratio and I am afraid that he will pay late. Can I make him sell the truck?

if it is in your name - you are liable.

what he wants and what he can have are two different things.

has the truck issue not been decided upon by the Judge?

We haven't even began the process yet. I was going to do a self divorce but I am concerned about the vehicle being in my name. I wasn't sure what they could do regarding the truck. Can they just make us sell it? Or would they award it to him even though it is in my name? I can't afford the payments on it because I have a vehicle financed in my name too.

You can ask that court to order that he refinance or pay off the truck in X amount of days, and if he is unable to get financial or purchase outright that the truck be sold and if he fails to make the payments on time each month as long as it is your name the he is penalized in some way for damaging your credit.

Why not liquidate your assets now that you two know you can't afford to maintain seperately and purchase things separately that you each know you can afford on your own? With having 5 yrs left on the truck I would guess you are upside down.
