- in this case the OP hasn't made previous reports, so without a history of dv she would have a tougher time claiming self-defense. If she were to be unsuccessful, then the kids have lost two parents, the abuser and their mother. There are plenty of women seeing their kids thru bullet proof glass right now because they fought back against their abusers.
As the saying goes...and reality says is true...better judged by 12 than carried by 6. There's no appeals from the coffin.
- the emotional fallout for the kids who would be faced with the fact that their mom offed their dad would be horrendous.
Compared to having their dad kill their mom...and he goes to prison? It's sucky either way. At least one can be claimed as self defense...one is just murder<I won't bother with other options as I don't see they apply as he knows what can/will happen>.
The only way to avoid those ramifications would be to do it in a way to not get caught.
Much tougher to pull off unless the person is knowledgeable. Although I did see a report saying shows like CSI were teaching people to use better clean up methods to destroy evidence. And let's be honest...local cops ain't as talented as fake TV cops.
Or, heaven forbid, he got a clue, got help, and QUIT ABUSING.
While this would be great....how often does it happen? I don't know or have stats on this possibility. Most of the claims we hear on this site is where it gets worse over time.
Please research dv, explore the options available to you in your area, and always *ALWAYS* have an escape plan for you and the kids.
Yep. Best solution is to get away from a situation which is likely to go bad. Jut as someone with a gun shouldn't go looking for a bad situation where it might be needed....don't stay in a situation which can go bad at any time.
-------------------- If I agreed with you then we'd both be wrong.
