I have been married a little over 2 years, my wife has worked about 2 months. I have been paying for both of our cars and both of them are upside down. I told her I would pay for her car for 6 months before selling it if she couldnt refinance it in her name. Her dad is wanting me to give her the car and pay it off compeletly. Would any judge in his right mind make me support her after divorce? We have about $51,000 in debt and the cars are only worth $38,000. I told her I would take over all the debt and just sell her car. If it goes contested cant she be forced to pay half of our debt even though she didnt work during the marriage? The car she wants is in my name only, and my car is in both of our names. This is a Texas marriage.

You wont be required to support her.
Who gets/pays for what depends on when the asset/debt was aquired.

I think I would worry more about WHY I have $51,000 in debt and $38,000 in car debt! And you've only been married for TWO YEARS???? Good grief!

If I were to sell the car she wants to take before we get divorced would the judge say something like "How do you expect her to work if you sell her car?" and make me support her or buy her a car?

Screw what her FATHER says - since when does he get a vote what two consenting, MARRIED adults do.
If the car you want to sell is in your name only, sell it NOW, not later. I say this for two reasons:
1. If you're upside down now, it'll still be upside down in 6 months. Getting used car financing when a vehicle isn't worth blue book is virtually impossible. 2. Someone who has no substantial work history better have stellar credit in order to get auto financing. Without credit, without a job, and a car thats upside down, she won't be refinancing.
If you put it in the decree that she is to get it re-fi'd in 6 mos, and she doesn't, you'll have to file contempt and go back to court. More expense to you, and the judge will probably not do anything except tell her to get it done. Maybe he levies a fine, but its doubtful he'll do it the first time, so she could drag it out for quite awhile.
Either sell the vehicle now, or tell daddy's little girl to have daddy buy it from you. Reducing your mutual debt load is more important; she can figure out her transportation on her own.
