I hope somebody can help...I just filed for divorce from husband in Arizona. He has been violent for all of our 6 year marriage, so I waited until he go transferred to New Mexico, moved with him & then came back to do some work on a triplex we own. I have basically moved into empty middle unit. My 19yr step daughter just moved in beside me. She is hostile, spoiled, doesn't pay rent,& her dad has tried to involve her by asking me for things for him, etc. I have no money or attorney until I get temp orders. I haven't been able to work since Oct due to illeness, brought on by stress of marriage, no doubt. Can I get exclusive possession & have her leave?

My best guess would be no.
If you both own the triplex, then logically the solution would be for you to buy him out of his portion of the building, or just sell the place and divide the proceeds.

I agree. I'm just concerned about during the process. My husband is very controlling & difficult and has tried to put step-daughter in the middle already. I just told both of them that it wasn't her case & that I wouldn't go there. I think I need to get away from this toxic bunch, the sooner the better. As soon as temp hearing, I will get out of here. He can have it.

14lilly, It sure seems common that the women stop working when the marriage is on the rocks...Guys should do the same. Too bad they don't...

My guess is that since Arizona is a community property state, you are very unlikely to be awarded the triplex. I agree that the unit should be sold and the proceeds be divided by the court. I would definitely do your best to distance yourself from him and his family, even taking a monitary loss is worth it when your safety and sanity are on the line.
