I hired a lawyer and the contract was a $5K retainer upfront. At first she wanted no refund if settled early. She keeps it even if she settled in one hour. I didn't think that was right so I had her mark it out and I was to get monthly billing. This was my 2nd lawyer and most the work was done. We finalize within 6 weeks and I asked for a billing, she stated it was all used up. I did have to call her on various property and issues still outstanding and I could never get in touch with her. EVER! I asked again for my billing and nothing. Finally I got her and asked why she cannot call back, email etc and if she still was my lawyer. She says, ya know your case is like many other cases, sometimes you cannot get documents or your property. Your choice is to fill a contempt application to collect in court. I had emailed her about this very issue. What can I do to get my property? Was over $100K at that time. At that moment I was livid and asked for my file and she said would be ready in a few days. No mention of a bill then. So I pick up and a bill is waiting for me. $1300. She charged me $12.50 for her legal asst to take my number to have lawyer call me. I tried to call her a few times a week for months now. Is that normal for someone to charge you for just taking a message just to have lawyer call you? And is it not still your lawyers responsibility to help getting your property from ex/opposing counsel? As far as I am concerned she breached her own contract when I have it documented that I requested my billing many times. Matter of fact...I never even got one letter from her, even though on her billing says she cc to me many letters I never got from opposing counsel. Can I challenge her billing...looks like it is somewhat made up? What gives?
