Collection of Arrears

i will try to keep this brief. in jan 05 i was found in contempt of court for not paying $1700 in child support and $4500 in spousal support. the judge order that i pay the arrears at $100 per month in addition to the $2600 per month for the normal child and spousal support. in may i filed 2 tax ammendments for 2003 and 2004. these refunds were interecepted. Question: The judge ordered my arrears repaid at $100 per month...why is cse still interecepting my tax returns. the answer i got from cse was that the judge didnt say they could "only" collect $100 per month. what the hell? can they use same authority they r using to go beyond the judges order to put liens on my property and suspend my drivers license? any thoughts would be appreciated. thanks

CSE is correct. They may can collect from any government reimbursement in addiion to the $100 a month.

Ohhh yes, CSE can do whatever they want within their legal grounds to get that order to zero. Which is to attach just about any source of your income or assets, liquid or not. As an FYI ~ spousal support is NOT subject to tax intercept. However, they can modify your account to take it and it is within their power to do so. Good luck fighting an intercept when you owe back support ~ it will never happen. After 30 days the $$ is sent to the plt and no longer in CSE to refund to you anyway.

It's that simple. You are paying $100 a month which would take 5 years to pay off if you were to never get behind again. The tax intercept knocks the arrearage down and you will pay it off faster. Why fight the intercept? The faster you pay it off, the less interest you pay.
