Florida versus Pennsylvania
      #20624 - 07/12/05 08:13 AM

Would I be better off filing a divorce in Florida or Pennsylvania? Are the spousal support laws better for the non working spouse? I put my spouse threw Medical school and he now resides in Florida..

Well there are residency requirements for divorce filing, usually you must live in a state around six months before you can file for divorce. You can't just pick and choose what state you can divorce in. How long have you been married and how many children do you have?

If you're a non-working spouse, how were you able to put your husband through medical school? How long were you married, are there any kids, and assuming you have had work experience, why are you now not working?

Thanks for your response...

I was a special education teacher for 20 plus years. The deal was I put him threw school and then I would be able to quit and devote my time to our three daughters. My ex was listed as a full time student on our tax returns. I Had monies saved from my father that was also used to educate him. The downpayment on our home in Florida was loaned to us by my Mother and has yet to be returned. He resides in our home and I live in Pa. with my Mother. I was married for about 16 years.
I do recieve support. Court ordered in Pa. I was thinking of forcing the issue to finalize but wondered if on state would be more beneficial than another. I have had an attorney tell me he thinks I should get permanent Spousal support but I wonder if that is realistic?

Well if you have already filed in PA and you have a PA court order, then PA has jurisdiction.

PA has jurisdiction as your order is here, and you can register your PSA at your DRO for enforcement.... be glad PA has it... they are top in the country for obligations and enforcement.
