Ok...so this will be the first year I file taxes after our divorce and I have some questions: (btw there is nothing in our decree about who claims what kids or when)
1. Do I claim the child support I receive? Where/how?
2. There are 3 kids involved. If I want to claim one and allow him (i'm the CP) to claim the other two what do I need to do? Isn't there a form or something to waive my right to their exemptions for this year?
3. If I do allow him to claim the exemption on those two would I need to get my child care provider to give me a seperate form for the expenses of each child so that he could have the amounts for them?
I hate taxes...someone please help me out here

1. No.
2. Form 8332
3. Did he pay said expenses? If not, then why should he get a credit for them?
PS: You have two kids together and one from a prior marriage, why not claim one of each?

Ok I finally found something on IRS.gov re: question 1 ...so I know that neither of us claim/deduct anythign for the child support paid.
I also found the form to waive my right to claim an exemption for the kids.
Even if I allow him to claim 2 of the kids...can *I* still claim all of the child care costs? I thought maybe it would be better to get my daycare provider (she's a state licensed home daycare) to just fill out a seperated child care expenses statement for each of the 3 kids.
ALSO...another question...since I have been received state funded child care assistance is this anything that has to do with my taxes or do I just file with the amount that I personally paid???

State funded child care doesn't count, so you're right, whatever you paid personally.
I believe that our ex claims the child care for both kids. I think she claims one as "dependent care expenses" and the rest as "nondependent care expenses".

Ok. I don't suppose it really makes much difference. Either way someone is getting a credit for it regardless of who actually paid it.

I think the only reason we never did is because we can't "prove" we paid it. She writes the checks to daycare. I bet if she was willing...oh nevermind, she wouldn't be!
No, in your case it probably won't, but I'd try it both ways to see. Luckily your ex is willing to do whatever maximized your return!

I have receipts for all the CC costs but it's not like they need to be attached to the return so if he claims 2 of the kids, I'll just have the daycare provider do seperate statements and give him what was paid for 2 of them. This is so confusing but I'm too cheap to pay someone to do my taxes for me LOL.

No, if you paid it, you claim it. He cannot claim what you paid, even if he claims the kids.

Oh, I just didn't think I could claim it if I wasn't claiming the kids. Thanks!!
