Legal seperation in VA

Does anyone know what it takes to be legally seperated in VA in order to file?

If it's contested , you're gonna have a problem . You'll both have to agree to the divorce and all the peripheral issues ( child custody , child support , spousal support & property division ) . This can explain the process better than I could .

There is no such thing as a "legal separation" document in Virginia. If you are separated, you are "legally separated" (since you cannot go to jail just for being separated). No court order or documentation is necessary to further legitimize the separation. However, if you and your spouse are sure a divorce is imminent and are still talking, it may be advisable to begin discussing entering into a separation agreement (a/k/a Property Settlement Agreement) to handle civilly the issues that otherwise would need to be resolved in court.

Well I would like this info as well.

Im 28 live in Virginia, have 4 kids. We already discussed the dividing of property, well mor elike me telling him what I paid for and that im taking that. This will be contested as he says he wont let me go. I'll just google some stuff

I know In VA you need to be separated for a year (if you have kids) before you can divorce. Does that mean you don't have to file any document to the court before the separation, and just separate for a year and then file for divorce?

Also, is living in separate rooms of the same house considered "separated"?
