My attorney ignores that she looted all I had

Warning: long winded) 2.5 years ago, I found myself homeless, broke and all my belongings vandalized and looted. She confessed to taking valuables to the pawn shop. And all the 1000 personal items like photographs were destroyed 'cos shee is malicious and projects all her anger and hatred onto me.
She somehow managed to deposit stolen checks into her account (one each was from the IRS and FTB, the 3rd a $ 2,000 check from a builder). And the Cops caught her with a Meth pipe and stoned.
When a wife wants the man out, this is it. No way could I return (sleeping in my truck for weeks - no work permit being a foreigner and the home office was locked forever). Times were tough...

Some girlfriend advised her to cover her tracks and file a DV-200 form to get a TRO. Here is what happened in court 3/2005:

Judge: "you have no grounds...". she: loud crying. every body is shocked and thinks I abused her badly... So she gets a TRO for 1 month!

Next month, her excuse for not having served me was "the Police told me, this is not necessary", conjuring up images of violence and drunken abuse. None of that ever took place, but voila, she got the tRO extended another month!

May 2003, the judge would not even ask about service - he restrained both of us for 6 months which was bizarre as she had already looted everything I possessed.

Here are cases where abusive and criminal spouses can continue to see the children and I wonder what went wrong as even in her e-mail in which she informed me that she would take over the house, she complains of me having "eaten a whole loaf of bread" and not any kind of violence.

Apparently, being a man means a judge can violate your most basic Constitutional rights! I understand that once a woman wants to stay away from a man that man should not come near her, no but or if. Abuses of the DV-200 form will cause a backlash one day and women like my STBX are causing problems for genuine abuse cases.

I don't understand your post. You started by saying your attorney ignores that she looted your stuff, but then the whole posts centers around her filing a TRO and the judge granting it and extending it. What does the lawyer have to do with this? Did the lawyer represent you against the TRO? Did the lawyer file a similar TRO on her since you had PROOF of her demands and threats to take things and of all the damage and stealing/forging checks?

Sorry, Char Fox.
I have been frustrated by the unwillingness of the lawyer to even bring up what I call the looting. Neither this nor forged checks or that 15% hard money loan which was on the property when we married and then paid off by me a few months later was even mentioned.

The judge was told this was "only about the house". In joint tenants. I fear she will get half unless the court learns of
her stealing my checks and depositing those with forged signature etc.

The TRO abuse of the legal system is still rankling, as I find it extremely unfair.

Agree. Just be prepared for worse. The courts are extremely anti-male in these matters.

Then I'd say it's time to shop for a new attorney. If your attorney isn't listening to you, nor giving you good reason why they're not bringing this info to the judge's attention, you need to drop them like a hot potato.

Is there a divorce in the works? Is that what you are waiting to be served with? Why don't you file,if there isn't? Sounds like temporary orders are needed here badly.
