copies of complaint filed with police
      #331587 - 12/11/07 12:12 AM

I filed for divorce from my husband 3 months ago, however he will not leave the house. I had to call the police tonight because he would not leave me alone. I had to tell 1 officer my side of the story while he told the other officer his side of the story. I heard some of the things he was saying which were lies (which I knew he would do). Can I get a copy of what he said to the police. If not can my lawyer?

It should be in the police report, which anybody can get access to. Just go to the police station and request a copy.

In the end though... [Re: Goodmom]

It won't really matter. He can lie to whomever he wants. It usually won't impact the divorce. won't matter to the cops unless you have an order that orders him to leave the house. Otherwise, filed divorce or no, you both still have the right to live there unless a court says otherwise, and the cops can't make either of you leave barring that or family violence.

But if it can be proven that he lied, then she has a better chance of getting a court order getting him out.

Although, it looks like this is a he said, she said type of situation. Hard to prove. But she can get a copy of the police report and see what they put in there.
