hitting husband what should i do about the kids.

my husband had hit me and my kids he is very controling. he hit me yesterday and left me on the side of a busy highway. he has my kids. i called the cops he well have a warrent out for his arrest in a couple days. but my plan is to act all nice and sweet to him were he well come back for me. then while he at work i well take the call the cops and tell the he has a warrent and hopefully the well arrest him but i worried cuz we don't live in the city were the warrent was issued. and i am trying to get to iowa from tx i have family there. and i am scared if i stay in texas he well find me and i don't know what he well do. i don't know how i well get there cuz my husband never allowes me to have any money leave the house or workhe is very controling.

here are my ????

can i take my kids to ia without getting any kidnaping charges on me???

can i file for a divorce in ia even though i was married and lived intexas????

can i get help to get to ia???? if so who do i call.

i am ready to leave!!!!!

--> As long as a custody order is not in place granting him custody of the kids, you have as much right to travel with the kids as he does.

--> You have to meet the residency requirements for whatever state you file in. For TX you must be a legal resident for at least 90 days. For IA it looks like at least one of you needs to be a resident for at least a year. You should contact an atty in IA as soon as you get there.

can i get help to get to ia???? if so who do i call.
--> Your best bet will be to call your family. Other than that, call your local abuse shelter for the county you're in. They will be better able to direct you to local resources that will help you leave the situation.

Things to think of before you leave:
- copies of the kids and your birth certificates.
- if you and the kids are covered by his health insurance write down the info from the card or make a copy of it.
- make a list of all the phone #s for pediatricians, dentists and schools. Add atty phone#s for you local area, the case # from your police report, the name of the seargant or officer you spoke with.
- If you have the opportunity to, write down any financial information you come across.

I'm mostly telling you to write down the info rather than make copies because unless your H doesn't pay that close of attn, I would not risk doing more than writing things down. KWIM?

Whatever you do write down you need to put someplace that he will not get access to. A trusted friend that would not be influenced or intimidated. The police should've given you a number for an abuse shelter. CALL THEM. Explain the situation - they've heard it before and can offer much more relevant advice.

Dont act "all nice"...there are warrants..you need to cut off all contact with the beater immediately until things are worked out in court.

I agree with Relayer. Stay away! The warrant will be out and you'll have the kids. A shelter may be able to help you get away. If you play nice and he gets arrested, he'll end up getting more angry... just let the police deal with it...
