Yes, if it was final after December 31, 2007. If it was final ON or before December 31, 2007, you cannot file a joint return for 2007.

what about EIC, if NCP gets 2 kids to claim this year and I get 1, who gets EIC? Or should I say can I claim just the one or all 3?

The EIC is totally separate from who can claim or will claim dependants. I just went through the calculation for EIC using turbotax and all the kids were qualified kids for EIC even though I am only claiming 1 and ex is claiming 2.
