question about "extras"
      #388852 - 04/12/08 01:53 PM

Do you ask for that when you do CS or do you do that when custody is awarded.

I mean for stuff like scouts, band, sports.

Thanks

We did. Its in the Custody agreement. We did a dissolution & were able to agree on things. We're to pay half of any school activities & sports (cause here we have to travel by boat or plane to compete against other schools--its the cost of living here), any any associated equipment (like band instruments, swimsuits, etc.) medical, child-care (so long as its for work). Any vacations are up to the parent vacationing with the kids.
I've never held the father to this agreement. The one time I asked him to help pay for child-care for the summer he told me he hadn't agreed to the activity or the choice of care provider, so he wasn't going to pay. I could take him to court over it.
I decided to pick my battles. I'm saving court for when it really matters.

Like ARVM stated in voluntary agreements you can put in anything you want.

BUT if you are having custody decided by a judge then he/she will write up the custody order. I only know of a couple of states that award "extras".

Most states won't/don't because they figure if will just result in another thing for the parties to fight over.

In states like TN, they have a provision for extras, but they usually have to be agreed upon.

Some exceptions will things such as tutoring, where it can be proven that it is needed.

Extra's are almost always by agreement.

The safest thing to do is have it specifically outlined in the court order at the time cs is awarded. Of course, it also depends on how reasonable and involved your ex is. My DH's ex wanted more cs to help cover extracurricular type expenses, so he agreed to send her an extra check each month to cover what she felt was reasonable. Some people are flexible and willing - others, not so much. Better to be safe than sorry and get in etched in a court order.

CS technically should take care of ALL extra's. They are taken into account in these wise and profound guidelines already. If someone wants to pay more fine, but it's not required unless in a CO and it's unusual that it is not by agreement. (I mean useless crap like scoccer or ballet, not braces or medical stuff)
