I have a dear friend that is a NCP. He has never missed a payment of CS and pays 1200 a month for 2 children. He also pays for their insurance as court ordered, he said that insurance cost 250 a month. It is really great insurance as he is union and it is through his employer. The other day he got a summons to court from the state that his CP and children live. The state is suing him for his 1/2 of medical bills that his insurance did not cover. It goes back for 4 years and is a very large sum.
We found out that she has also been on medicaid and that whatever his insurance doesn't cover, then medicaid picks up the rest. He said that the CP has 30 days to send him the bill for him to pay for his 1/2. She is to pay 1/2 and all deductables. She never sent them, so he has never paid his 1/2. However, she wasn't paying herself, so how could she send anything? Is this legal, can they do this? I cannot even begin to understand how he is responsible for this. Is she allowed to be on state insurance when he is paying for their insurance? I just don't understand and have never heard of such. Anyone we have talked to said that they believe that the CP is the one that should be sued not NCP.
Has anyone here heard of this?

Once the CP goes on state aid everything gets all mucked up. I never understood the logic of holding the parent who is NOT on state aid responsible for it. Especially when the NCP is paying child support. That is just insane...

The key is that the state is suing him. They are collecting for the part medicaid had to cover.
The CP can get the bills from the doctor's or she can request it from medicaid more than likely, so she can find out what was paid outside of his health insurance.
I know its stills stinks. I would also wonder how she got medicaid in the first place if they children are covered under another plan and he pays that much childsupport. Could she have been less than truthful when she applied for the assistance?

That is our thinking. The CP in this case makes around 35k a year and gets CS. I would think that she would not be able to get that. The NCPs insurance covers 100% as long as she takes the children to an in-network doctor. And it states in CO that he pays no out of pocket expense if she takes them to an out-of-network doctor, the rest owed is hers to pay.
He has talked to one lawyer, but he doesn't want to take it on because he said that is was against the state and that more than likely they would win. It just seems really unfair and unjust to me. I believe that they should be going after her not him. She is the one that has sole custody of the children, I just am beyond belief. I have never heard of this and am at a lose as to what to tell him to do. Or what to look for as far as laws on this?
The CP in this case will not work with him and tell him anything, he has tried. She thinks it funny.
