You'd think I would know this, but whatever. My ex is throwing a hissy about paying his half of the medical bills for our son, totaling $609.36 (from 2006 to present). I have mailed him these bills before, but he said he's never received them (I know...should have done the whole return receipt thing). Anyway...I have not paid all of these medical bills yet. Some of them I am making monthly payments on (the larger ones). He said he wants to pay the provider directly. I would not NORMALLY have a problem with this...but I know they won't get paid. He doesn't even pay his CS, (he is over 8K behind and only pays it when he holds down a job long enough for his employer to garnish) so why would he pay these? These bills are under either DH's name or mine, and if they are not paid they will be reported to the credit bureaus.
He wants me to give him the bills (EOBs) at court on Thursday (a contempt hearing for his not paying CS). I said fine..that's what I'll do.
So anyway, WWYD? He has an attorney now, btw...I am pro se..actually the state is handling the CS contempt issue). Should I continue to ask him to pay me..and I make sure it's sent to the provider, or let him? I really can't trust him and we DON'T need any other bad marks on our credit.

The state should garnish it along with CS, and then send it to you.

Well I told him that they would more than likely be willing to add it to his arrearage, but he wasn't going for that. Don't see why not when he has such a large arrerage anyway. But..the half for medical bills after insurance has paid is supposed to be paid seperately.

lol I agree. Now he has this attorney telling him to do all sorts of things I think...getting on my nerves.

in what he's "going" for. If you ask the courts to add the amount to the arrearages, they will most likely grant your request. End of story. The only way he can't "GO" for this is if he up and pays right then. If he wants to pay the providers directly, then I guess you would have to have it written into the orders that you be supplied with a copy of a paid invoice or receipt from the provider indicating that his portion has been paid. AND that he has a specific period of time in which to do this. I would also request that the amount unpaid after the final due date automatically be added to the arrears should he fail to make good.

Good idea. When we go to court on THursday, I'll ask them if they would add this amount to the arrears.

They wont add it to the arrears because you havent paid the $609.36 either, unless that has been part of your monthly payment. Otherwise, you are not responsible for any of it?

Doesn't matter if she has paid her part or not, if it is owed they can attach it to his arrearages. BTDT
What a loser. He's already got a hell of an arrearage, what's the big deal if they tack the meds on??!! Besides, not like he'll pay them anyway.
Do you even have room to bytch about the meds when you're that far behind in CS and haven't even ATTEMPTED to make it right?!! Some people apparently think so!!!

The $609.36 is the BF portion of the medical bills. She has paid some of the bill off but is still making monthly payments on some of the larger bills. It seems that she was unable to pay the bill in full so she made arrangements with the providers.
M5, ask the court to add it to his arreages.
