Hi Everyone, I am in need of a whole lot of information regarding NY divorce law. My sister is currently married to a verbally abusive husband whom is completely useless. They have two babies under ine and he does nothing to help. She works her but off all day and has no help at home. If she dares to ask for help she gets cursed out in front of the children. All he does is sit on his butt and play with his hobbies. He does work, but off the books. She does have health insurance and 401k through her job. Thank God! Not that it makes a difference now but he was in rehab before they got married, a few times. These are my main concerns. Custody is my first concern as well as him getting her money. I am out of state and would love for her to be able to here but I am sure this is an issue. ANy input would be greatly appreciated.

First of all, she's has got to get in touch with a Lawyer in New York asap. They do offer initial free consultation. Let her know to check out the phone books. She can not take off with the kids. He can have her bought back to the state with the kids. It's going to look really bad for her if she walks with the kids.
He sounds like a winner, but he is their dad and she did chose him to be by her side till death do they part. So now they are pretty much stuck working together till the kids are 21 in the eyes of NY State as far as dealing with the children. They are going to have to work together now for the sake of the childre and act like adults. Her running from this problem isn't going to solve it.
