Spouse getting away with theft!

I am seperated from my spouse and she got into my mypay account, printed my W-2 and filed for income taxes as married. She received 4089.00 and I did not see a penny of it. Is there any way I can use the half that she stole to cover the support payments I have been sending her. She has already received way more than what she is authorized over the past twelve months and I have the documents to prove it. Is there such a thing as a no maintenence due order?

1. Flag the IRS, can you call them and tell them she forged your return?

2. Flag Mypay. Isn't that a big no no what she did?

Do what you can with the IRS. On Mypay, you are supposed to keep your [censored] secure, she didn't change any allotments or witholding, and she printed one form, I don't see anyone raising a stink about it. I would guees you have already changed your [censored], but at least you will be ready for next year.

It is not that hard to change the Mypay pass word. All she has to do is know the SSAN.

That makes sense if she had the [censored] to the email he registered with, but if he had changed his stuff, this would not have happened, and I think he can avoid it in the future.

Well the email we registered with was in Germany. I don't think we have ever changed the pass word.

So it seems you would have to change both to be sure, from what I can tell.

You can flag mypay so that it can only be changed in person, but the horse is already out of the barn so to speak. From this point I would contact the IRS and find out what to do - file his own return as married filing separately and let the IRS sort it out?

And no - you can't use this as support payments. SHE screwed herself here - don't get mud on yourself by giving payback. Keep your nose clean and do what is right. Then she will be the only one engaging in illegal activities.
