can't get husband to settle after 3 years in court
      #397604 - 05/02/08 03:53 PM

Hi - I'm desperate for ideas! I've been in the process of divorce since March 2005. We had a final hearing in May 2007, then before property settlement judgment was entered, I found that my spouse had purchased two houses with marital money that he did not disclose (obviously I was unaware at the time). So I have gone back to court with this new information, but it's draining many thousands of dollars. We don't have that much to fight over and what's there is 1) going to attorneys and 2) in real estate so not liquid now anyway.

My x steadfastly has refused to make any fair settlement. Is there any way to end the process without another year of court hearings, etc? My x is very adept at playing the system and creating delays, requesting additional documents but not providing anything from his side, etc.

Thank you for any advice- I'm currently spending about $5000 a month on this, and I'm in huge debt and can't afford for it to keep going.

I'm wondering if my stbx will ever settle. He's just the sort of person who would drag this divorce out just for spite. Of course my siuation is different..as I am still living under the same roof. So since he was the one to file and wants out..(he thought he wouldn't have to make a settlement that I would just be tossed out by a judge) anyway I'm still under the same roof so if he doesn't make an offer I'm not going anywhere.

If you beleieve that there is subnstantial equity in the real estate, you would have to file a Motion for fraud and to vacate the agreement. THat puts you back on the litigation path.
