Separation and moving to home of record

Good morning all. As I have posted in a couple threads, my wife who is active duty AF wants a divorce and has no interest in staying married. My question is, do I have to pay my own way home? I'm sure this is a silly question and I'm pretty sure the answer is yes. I had somehow assumed that once a separation agreement was signed the military would pack me up and move me to my home of record. I asked at legal assistance and I was informed that I'm on my on moving home. My wife who is a JAG attorney, knows that I think this. I guess that is the procedure for overseas, and we we're stationed in Hawaii the previous 3 years.

Basically its not a government directed move or for the convenience of the government, so you will be paying for it. having said that, there are always exceptions, so give transportation a call, see what they say about a move, what it would take, talk to the personnel section, even start looking in the regulations yourself, there may be exactly what your looking for and there may not, but you should give it a try.

DH was ordered as a part of the divorce decree to cover the cost of his ex's move back to her home. So you can always ask.

Thanks for your responses. I do plan on looking into it. I'm meeting with yet another attorney, this one is a former JAG. Last week, my wife who has not been living in the house since late March entered the home on 2 occasions while I was at work. On the first she removed personal items belonging to me as well as some of her stuff. On her second she removed all of the household goods that she wanted. Her being a JAG attorney makes this process difficult b/c she knows what she can get away with.

Did you call her boss like I said and the IG? She cannot take your personal items without permission. Change the locks.

THe IG is an excellent suggestion. A JAG officer should be held to higher standards.

If her name is on the house, you cannot prevent her from entering. What you can do is take pictures of all the stuff and if she takes anything else, you will have proof that it was once in the house. She can be held accountable for anything that is missing.

Thanks again for all of your responses. I did take pictures of what was in the house and have all of the reciepts. Her attorney informed mine that I could ask for anything back and they would either return them or give me money for them.

I have not contacted her commander or IG yet. If she can stay out of the house and not take the car we own until I finish the school year, I'm willing to not go that route. And after I use the car to tow the little remaining items in the house she left, I will then sell the car and give her what we agree to.

If she continues to make my life more difficult than she has, than yes I'll contact her commander, IG and some other recommendations.

From what a former JAG attorney explained to me is that superisors and commanders typically side with the soldier, especially when concerning a woman and especially when it's the Air Force. How true this is, I don't know but that is what he said. He also said she hired the top attorney in the area, Susan Hicks. She charges top $$.

Yes, the AF does usually side with the soldier. It is different than other branches that have written regulations on how much they have to pay the spouse, etc. (I just divorced my AF husband...TG!)
