Until recently (2 months ago) i lived in new orleans. my son and his mother(the custodial parent) lived in new orleans as well. we have joint custody and i have liberal visitation (every other weekend, alternating holidays, etc). prior to the hurricane we all evacuated and ended up in houston. houston is huge i live on one side of the city and she lives on the other. its at least an hour and a half drive one way. because of this my visitation has been altered. i cant pick him up every other weekend. in order for me to drop him at school on monday morning i have to leave home at 5am which means getting him up at 4am. my son is falling asleep in class. now she wants to relocate to virginia. i think she will and there isnt anything i can do about it. any thoughts?

wow. you are kind of in a tough spot.
due to the hurricane, neither of you have been able to set up a residency requirement for Houstan and at the moment it will be hard for to contact New Orleans courts ( or at least I think it may be )... have you tried talking to a lawyer in Houstan to see where you stand.
is she relocating with a job offer ?
since coming to Houstan, have either of you been able to set up gainful employment that was going to make Houstan a permanent residence or were there plans of moving back to New Orleans ?
I do agree that something would need to be addressed with your the reasoning that your son is falling asleep in school. he can't benefit from an education that way.
try talking to some lawyers for free counseling. hope all goes well.
