I recently divorce a Master Sergeant in the Military who lies about his income and brings in a copy of his pay check stub that he has created on his computer. I know he is lying about his income because the base pay online (that anyone can view) is more than the amount he has on his fake copy. how do you beat this and get the judge to see his is lying when you can't even get help from his superiors on base. How do you get this information sent to you or your lawyer

Actually you can print your LES from your home PC, but whether thats what he is doing or not, I have no idea. As far as I know, you would have your lawyer request it through the courts, and maybe get a copy through DFAS, or his tax return. I would think your lawyer would best know how to do this.

You can go to public web sites and find military pay based on service, rank and years served. It's public information.

You have to realize that once he's divorced, he will probably go live in the barracks, which will take his housing allowance away, thus not be able to be computed in the child support.

it may or it may not, in some branches, E7s and above can draw BAH regardless of their marital status, his rate may change, but a divorce does not always mean the only housing allowance one is entitled to is the barracks or dorms or single soldier quarters or whatever they are calling them these days. Only time will tell.

No E-7 in the AF lives in the dorms unless he is on a remote or TDY. Those days are long gone...

Yup - the AF is pretty darn nice to their airmen. 16 years ago, I was a single E-4 living off base. Take home with all of the extra allowances, even back then, was pretty darn nice.

And if that were the case, would he lose his housing allowance????

I would assume so if he was single with no dependents, but since he has dependents I would think he would get a form of BAH, right?
BAH was never included in my huaband's CS equation. Just base and flight pay.

I mneant if they were how you said, remote, I know they would not if they were TDY, but like BAS these days, never lost, even when you are deployed.

The AF BAH is not calculated on # of dependants, it's either with or without. And NO E7 lives in the barraks. Even if he lives on base, most bases are now charging 'rent' for base housing. So they still get BAH.

They are doing that with single enlisted as well, giving them BAH and taking it right back? Where do the single E7s who live on the base live. I know on some Army installations, if there is room, they will give Single Senior NCOs a two bedroom set of quarters as their housing, and they would do the BAH thing, but not all installations have the room. How does it work in the AF?

It is not COMMON, but at every base we've been to there were single quarters available for everyone. Either DH or someone he was working with who was divorcing and getting on their feet lived in the barracks. There is also space for geographical bachelors. I think DH kept his BAH though and they just charged him a fee equal to single BAH. I know the other services are a little more AR about it, but DH lived in the BOQ with some E-7 and aboves while in CHarleston as an O-1. Khaki housing is what they call it in the submarine community, LOL.

Most places in the Army have Senior enlisted quarters, some don't. I was stationed at a place as an E5 and had to draw BAH because there were not enough quarters, but that was unusual. But as usual, the Air Force leads the way in quality of life.

The only reason i mentioned that he might opt for the barracks is just to deny the usage of BAH, then move out once its computed. We have put senior enlisted in the barracks for short times in the past.
