Adoption by the SD

Does anyone have any idea what happens when the birth father agrees to let the SD adopt ?? My X is over 10,000 in the hole with the AG and I'd like to start the paperwork for the adoption. It kinda makes me mad that his debt would be wiped clean... SOME reimburssment would be nice..

Depends on the state.

From what I've seen, an adoption kills any future debt, but does not erase any already existing debt.

Thats what I've been told by others.. although I have found everyone seems to have their own take on it.. What scares me is that he seems to think this will "set him free" personally, I don't know if I can make that decision, the state may intervine.. but I don't want to let $$ be the reson the adoption doesn't go through.. I have made it this long w/o help, but never expected he'd be responsible for future payments.. It makes me sick to think he could prolong this simply because he doesn't want to pay child support...

He will still owe the arrears they are not wiped clean.

Not always true! When my dad adopted me at 4 yrs old and my sister at 6 yrs old sperm donor owed $21,600. When the adoption was final they gave him a $0 balance. That's why he gave us up. He basically sold us. I have copies of all the papers. He does not deny basically selling us.

Sounds like a deal struck as a deviation. That's why I said that "it depends."

My girlfriend's husband just adopted her twins. her ex's arrears were not wiped clean and he still owes in the area of 45K. This is in WI. I don't think courts can just erase arrears without an agreement.

I don't know.. I think my son maybe up for "auction".. I may try to explain the prior debt remains.. this will simply get him out of future debt..Not sure how the law is here in Tx.. ususally it's pretty fair.. Tx is pretty tough on dead beat moms/dads..
