Need Advice

Hello Everyone

There are several custody issues with my Ex Husband in regards to our 4 yr old Daughter.My Ex-Husband has moved from Southeast Wisconsin to Round Lake Illinois roughly 54 mins to a hour away. As our agreement states at this time due to his work schedule ( he works nights starting roughly 7pm until anywhere ranging until noon or so the following day. We have joint legal custody. I have primary placement and he has secondary and his placement as follows Mondays overnight, weds overnight and every other saturday. Should I have received written notice of his move and a chance to reply with objections and being that he is now out of state does this matter ? If anyone has any knowledge of this please any advice would be wonderful... One of my concerns is that our daughter should be starting preschool and needs stability among the many other issues at hand. I never knew he had intentions of moving nor received a letter.

You can ask for a custody modification since he moved across state lines. He will not lose any time but rather it will be adjusted to reflect the change if anything. If he is okay with this schedule and all the driving it requires it may not be changed. Spending time with her father trumps preschool. When she starts kindergarten it will be another story UNLESS he is still okay with transporting her and is able to get her to school on time. WI is very reluctant to make changes.

No he did not have to give you notice and there is nothing for you to object to. He can move anywhere he likes, you can move anywhere YOU like. The only objection available is to the child being relocated, which has not been done.

My CO states that if there is a change of residence of either parent, it has to be discussed with the other parent before any change is made.

Since she didn't mention anything that was CO specific I answered based on what I am aware of from dealing with the state of WI.
I would think if there was something similar in her CO she would have mentioned it as it's a pretty important piece of information.
