I live in FL and I am planning on filing for divorce. Question is, in our state, does all the debt need to be divided equally? If one person agrees to take more responsibility (credit cards) and that is agreed upon, is that allowed? Is your mortgage also considered as debt?

Hi gblvdgirl,
I don't know the answer to your question but you can probably find out from your state website what the statutes are for distribution of assets in your state.
In most states, if the two parties "agree" as to how they're going to handle the debt, you'll find that judges won't interfere, unless they think it's not in the best interest of children or something extreme. Courts prefer to see the two of you work out your own agreements and settle things, yourselves.
