Some Advice Plz

I have been married to a emtionally/mentally abusive man for 9 yrs. We have two kids. Both our names are on the lease for our home. How can I get him out of the house? I am disabled and cant afford the retainer for a lawyer right now but I need him out of the house. What options are there for me? Thank you for and advice you have.

SORRY TO TELL YOU, BUT I DID NOT HAVE MONEY EITHER, AND GETTING AN ATTORNEY IS THE BEST THING YOU ARE GONNA HAVE TO DO. YOU CAN FILE MOTION TO VACATE, BUT BEING THAT MENTALLY ABUSIVE, YOU NEED TO SPEAK WITH AN ATTORNEY. I BEAT MY HEAD OVER WAY TOO MANY TIMES OVER THIS AND I FINALLY HAD IT!

"Emotionally abusive" is a rather subjective term. When arguments occur, each side sees the other as emotionally abusive.

Nonetheless, once a divorce or legal separation is filed, either party may seek what is called a temporary hearing to determine who should have occupancy of the home, custody and parenting time arrangements and support arrangements pending the final divorce. If thre is no domestic abuse, you cannot remove either party without such a hearing.

Most states have nonprofit organization that will assist low income indivisuals in divorce proceedings. You may be able to get a list form your state bar association.
