I need to have my current child support order modified. It has been standing for the past eight years. My ex-husband has changed careers, he has remarried. I've re-married and I no longer work (haven't for 3 years).
My ex-husband has made comments that his current CS is too high ($264 per month) and he's having a hard time paying his bills and living comfortably. I don't care what amount he pays, it all goes into a savings account for our son.
So, here's where my question comes in: My husband is active duty. My gross income is to be imputed, because I don't work.. but my husbands income is supposed to be noted because we're married. My husband wants to know if CS takes into consideration Base pay only or if his BCA (Basic Clothing Allowance) and/or his BAH (Basic Allowance for Housing) are to be considered also?

With me and my ex, who is active, it takes in account all three. But he is the one paying CS. It depends on which state and their laws, but typically they do not include spouses income. What state are you in?

We live in Washington state. The Worksheet states it does not take into consideration the spouses income, but it does need to be noted. So, I just wasn't sure what to make note of.. taxable or non-taxable.

I would do both just to play it safe, but if you are going in to the court, the judge or mediator can make the adjustment as necessary.

child support is calculated by both the mom and dad's salary. You can check with your attorney for more information on this.

Child support calculations are totally dependent on the state as many states only take ONE income (the noncustodial parent) into consideration.
