Lawyer refund

My attorney thought we would have a huge custody battle with my ex wife but that didn't happen. I had given my attoney quite a bit of money to put in a escrow for witnesses and such but never had to have any. Since I am pretty sure there should be some money left over won't he issue me a refund of any money not used? How long should this take?

Has the divorce been finalized? He may keep some of it until the actually court date to get in front of the judge and get it signed off.

There is no reason you couldn't ask for an accounting now and for a refund of everything minus what he thinks would be needed to get everything buttoned up.

It wasn't a divorce issue, we were in court to decide where our daughter would attend school. she was also going to fight for full custody but after the GAL report that kind of went down the drain.

There is no reason why you couldn't get a refund now. You should ask for it- believe me your lawyer isn't going to automatically "remember" that you are owed it.

Can you get a lawyer refund if a lawyer screws up your case?

I don't know. I just want back the money he didn't use on my case. We put some in escrow and didn't use it all.

It's up to you to monitor you lawyer and his behavior. Unless he purposely defrauded you and you can prove it, you aren't going to get anything back.

My guess is you didn't listen to his advice and now you are getting the short end of the stick in the settlement.

I sure hope your talking about the person that asked for a refund because her case didn't go her way. My case was simple and since we didn't have to use all the money in escrow because we didn't have to have any witnesses I just want the left over money that we put aside for all the witnesses. My case went fine. I am not asking for a "refund" I paid my attorney.

I think he purposely defrauded me, he told me stbx would only get 5 yrs of alimony and I would only have to pay her $1000.

Cetillman2- Sorry for the confusion. I was talking to Stuck. He's a sorry excuse for a human being. If you want a good laugh, read some of his posts and this communities replies.

Personally I think he is secretly a psychology student doing his thesis on the reactions of closed communities to socially inappropriate behavior. And those of us on this board are his experiment.

At least I hope that's the case because no one could be as stupid as this guy is. Could they?
