Bankruptcy, divorce and the house

Next month, my spouse will move out of the house we live in.

The mortgage and title are in my name. The house was acquired during marriage.

The debts incurred during marriage she refuses to pay for (RV, car and credit cards) and are all in my name. We rely on dual incomes so, withoout her income, I will start falling behind next month. My credit is perfect with no blemishes.

If I file a Chapter 7 next month to discharge all debt except for the house what happens if the judge orders me to sell the house in 6 months? This would leave me with the mortgage company coming after me with the balance and since I already filed, I cannot file again. I am not sure why the judge would order this because the house would require a foreclosure since we owe 200K more than what the house is worth. However, she feels entitled to part of the house. She wanted me to pay her half of the market value. I told her she was nuts.

I think it's more likely that the judge will order her to pay for half of the debts.

She's entitled to half of the equity... doesn't sound like their is equity, other than negative! Make her pay for half of it.

HI,

Can you get into court before this happens? At least to settle the issue with the house? Maybe if you call the mortgage company and explain the situation they maybe willing to work with you until things get settled........

John, you can try to get a modification from the mortgage company. They won't look at credit card bills...but they will consider, car payments, medical expenses, daycare, insurance, those kinds of things as monthly expenses. You might be able to cut your mortgage payment by half.
