We are doing the divorce through a mediation lawyer who's representing me, if that makes any since. husband is going into w/o lawyer. anyways he states once that i can claim 2 of the kid and i'll take our youngest. Is this fair? We see the lawyer on Thursday but I was thinking he could take the middle child but he says that's not fair b/c he'll be paying suport for the youngest for longest so he should claim her??? it's only 2 years we have 3 kids right now they are 8, 6, and 4. Any suggestions.

There are a few ways to do it. I'm not sure if you were saying that you claim 2 and he claims only 1 or vice versa. I am aslo assuming that you are going to be the CP.
You can put in that on even years you claim 2 and he claims one and than in odd years he claims two and you claim one. Once the older child is no longer apart of the order than you each claim one child and when the youngest is the only one than you switch years.
You can also ask for a clause that the NCP is able to claim the children ONLY if CS, childcare, and medical are current. If he is not current than he doesn't get to claim the child(ren) for that year only.

He was agreeing to letting me claim the older two and he would claim the youngest. i wanted to agree to him claiming the middle child. I will be the CP he will be the NCP. I like that clause he doesn't like any of the great clauses i've been finding on line, i'm sure he won't like that one either. he's going to have a heck of a time with medical since his insurance deductible is so high, ok that's enough of feeling sorry for him, i HAVE to stop that at some point right???

The IRS regulations recently changed regarding who gets to claim children; you should visit their website - Is it going to be 50/50 custody?

No he will have them around 80 over nights a year or so give or take... i'll have them the rest of the time...

Odds are he will claim one or more per year or you all will alternate years for claiming the kids. That is common.

If you think it's fair, the it is. I would put the proviso on there he has to be current with his CS
