Posting this for a friend. I posted all of the background for him in spousal support, so I will just post a property question here. She was awarded temp provisional 2 years ago to live in the house, and items were not to be removed from house. The day he left he tried to get some of his things. Her family was there and her brother told the cops that the wife asked him to get the guns out of the house, which he did. These were the husband's guns. Long story short. He is about to sign the final proposal which gives her spousal support due to disability, sell the house split the equity, she gets something like 90% of assets, he gets all the debts. He is ok with this due to her inability to work. He got a handful of assets she agreed to, including 3 guns and some garage items. 2 guns are missing and her brother will not give them back, and someone else found one of the garage items a year ago in a family rummage sale (and is returning it to husband now). Wife says too bad about guns (even though it is stated on proposal those are his). Husband asked for her to pay fair value of missing property from her half of tax return. She said no way and no guns. Husband says he is going to withhold fair value until guns come back and she can take it back to court if she thinks this is unfair. He also is thinking of letting it drop there, signing the paper, and letting her win this battle. He is worried if he doesn't sign and it goes to court she may end up with more spousal support than already agreed to, or may have to pay more legal fees than the guns are worth. And he has no proof of ownership, she has all papers and documents (or had). Any thoughts?
