Fiance owns home, getting married....

My fiance bought a new home about 9 months ago. We plan on getting married at the end of this summer. If we (my kids and I) decide to move in prior to getting married, what are my legal rights to his home, as well as other legal matters? Both while living together prior to marriage and after marriage. Thank you for you information.

Some of this answer depends on what state you are in and whether it is an equitable distribution state or a community property state. In a community property state, you would not own the portion of the home that he purchased before you married, but you would be entitled to half of the increase in equity after you married.

I think the real question here is: why are you asking this question? Are you planning on getting divorced before you even marry?

Anyone who is not a cynic want to try and give LEGAL advice, not "couple counseling"?? Thanks. :smirk:

That was kind of hateful. What Cinder told you is the way it is. You have NO claim on the house before the marriage no matter how long you live there before you are married and your only claim after you are married would be equity earned during the marriage but understand that with the economy the house might possibly be worth less than it was when he bought it.

There is nothing you can do to keep yourself from being tossed out of the home before the marriage except that in some cases he might be required to give you notice to vacate much like if you rent a home.

Also if you want legal advice see a lawyer. We can only give you our opinion.

Have you asked your fiance, I am sure he would understand you protecting yourself and your children. It is the prudent thing to do. explain it to him, and ask him, he lives in the area, he may have experience with a lawyer or the law there, and if he only bought it 9 months ago, he may still remember the lawyer he worked with, and maybe go that way.
