Florida Grandparent Visitation Rights
      #535481 - 05/16/09 11:05 PM

My son has informed me that I am cut off from visiting/seeing my grandchildren. He is like a little terrorist, using them as weapons/shields. In the interest of being concise, there is no reason good or otherwise for his behavior. I suspect it is the product of either drug/alcohol use or perhaps some type of undiagnosed mental illness. The children have got to be devastated...our times together are always filled with bliss and laughter. When it is time to take them home they usually have something new they need (clothes, shoes or whatever...) Not to mention the free babysitting...it is a total win/win for my son and his girlfriend (he abuses her...she has no self confidence...I don't think she is capable of standing up to him). Where do I begin the ball rolling?

It's extremely unlikely any sort of visitation would be awarded if the parents are still together .

Because they are grown-ups and have the right to make their own decisions regarding their children.

They're irresponsible meatheads who don't work, tattoo eachother and sleep till noon everyday in an alcohol and drug induced hang over while the kids are left unsupervised. I was hoping DCF wasn't going to be necessary, apparently DCF is the way to go.

You shouldn't expect a great deal of help from child protective services .

If the children are in an in tact family, most state laws will not have provisions to allow for grandparent visitation. It is deemed a decision that is firmly within the discretion of the parents. Only if there is a partnerity case, divorce or legal separation of parents is grandoparent visiation likely OR if the children lived exclusively with the gradparents for a defined statutory period.

You do not raise any specific issues that make CPS intervention likely.

You say your son and his girlfriend? Is the girlfriend also the childrens' mother? If she is, then you're sol. If she's NOT, then you may have something to go on.

As grandparents of four, I share your pain.
Our SIL was once habitually high and mad similar threats of preventing us from seeing his kids even though our daughter was in favor. He is a big guy who started making threats so it got nasty. He later dramatically changed after counseling and all seems to be well now. Maybe you can urge them to get counseling...
