Hi folks Just a quesion if I may regarding US law and juristiction. I am a UK resident separated from my wife (for 3 years now - she is living with our child in NY state). We intended on making an agreement between us for the divorce, involving child support, visitation, etc etc. Recently my wife has informed me that this is not possible, and that our agreement will be sumbitted to a court for 'approval' and if all the figures relating to child support are not what they deem to be sufficient they can and will reject the agreement. Also im told they will have the juristiction to enforce (from the US) payment by myself (a UK citzen living in the UK) what they deem necessary. Im also told that they may not take into account travel costs in this equation (roughly 5-6 thousand pounds per year).I am just trying to find out how much of this is true since im a little in the dark here. Thank you in advance. D.

I am a NY resident, and it is true that the papers would be put into the system for 'approval', they won't override what the 2 of you have agreed to. Granted, I've heard weird legal stuff before, and I'm no lawyer- the best bet would be to consult a lawyer, I'm sure a lawyer in NY could even set up a phone consultation with you. Whatever the cost of the consult could save you a considerable amount of money! The case might not have to go through NY courts at all- so even a local consult might be the best first step.
