My wife and I are in the process of a divorce. The initial filing has been done,(July of 09) we're still working out the financial paperwork. It has for the most part been amicable and easy, splitting property and such. It was originally agreed we would sell the house, and she would keep her car, and I would keep my truck. All three things still have loans in both of our names and we have each tried to re fi into one name, but we don't qualify because we have too much debt in our names. I am one signature away from being able to have my new girlfriend buy my truck (thus pay off the loan) for us to get it out of my wife's and my name, which was the ORIGINAL agreement between my soon to be ex wife and I that didn't get signed. There were some changes to that agreement, mainly that she would keep the house (it isn't going to sell and I cannot afford it...) When I informed my soon to be ex wife that I could get the loan paid off, she said that she wasn't sure she would sign over the truck because of emotional reasons - she thinks it would make it easier for me to walk away and leave her stuck- even though my name is still on her car loan and the house loan.
The registration on the vehicle is listed as OR (ie her OR I). Technically, I don't NEED her signature.... She has a lawyer, I don't. I don't know if I will be in the wrong or violating any law since the original paperwork has been filed.

In CA, you'd be in trouble for selling, so I'd advise against it. Other state laws may be different.
