SO MY WIFE MOVED OUT IN JULY ON HER OWN...I NEVER ASKED HER TO LEAVE...I HAVE SINCE FILED FOR DIVORCE AND WE ARE IN THE MIDDLE OF THAT...I HAVE ALSO FOUND OUT THAT SHE HAS BEEN SEEING SOMEONE SINCE AT LEAST MARCH...ALL HER BELONGINGS ARE OUT OF THE HOUSE ALSO...BUT SHE STILL HAS A KEY...SHE COMES IN EVERY ONCE IN A WHILE JUST TO DISRUPT THE HOUSEHOLD AND TAKES RANDOM THINGS...LIKE THE HOT SAUCE..(YES I'M SERIOUS)...CAN I CHANGE THE LOCKS TO KEEP HER OUT???

You can change the locks but she can also, legally, break in. Despite her moving out, it is still her house as well.
I know this is frustrating but that's the way it is.

It's still her home if they own it, if they are renting, it is not. I'd change the locks immediately. She may be able to legally break in, but it'd be clear that she was there if she did do that.

When I sat in court waiting on my divorce, the divorce in front of me was kinda like this...the wife came in and took things out of the house and the Judge made her return them...I don't know about the hot sauce. I know when I left my husband (his house, not mine) I left alot of stuff there and wished I had gotten them, but wouldn't dare ask muchless barg in and get it (before, during or after the divorce) it was my loss. Do women not have any sense now-a-days?? No "cooth" about anything?? Do they really have to clean out bank accounts?? I mean, come on...I'm a female but wouldnt dare do anything like that...sure I deserved more when I divorced...but I had a fork in me and I was done!! Know what I mean??

When my ex moved out without notice and later threatened to keep coming back in our home to take things, my lawyer added a quick restraining order on the home. My ex was not allowed to come within so many feet of the home (but close enough to come by to pick up the kids for visitation). This helped and I didn't even have to change the locks because he was too scared to go to jail, and I had neighbors keeping an eye out for him too.

I did not hear anything that would form a basis for a restraining order. She still is a legal co-owner of the residence.

Question Maury....if a wife marries someone that had a house the bought previously 10 years before with his and his first wife's name on the mortgage and never changed it during the 11 years she was married to him (gosh this is confusing)...does that new wife consitute being a legal co-owner of the residence?? Same as having an apartment without their name on the lease??
