Divorce Decree wording

I am looking to see how other decrees are worded in regards to seperation of retirement pay upon retirement. My decree only states that my ex gets 50% of the marital share of the military retirement, nothing else. I have sent it to the CG finance center and was told there is not enough information to separate the retirement from the wording of the decree. The pending question is should the factors be the amount of months that we were married and what my rank was when we were divorced or separated? Virginia has a long waiting period and they based the months of being married by the seperation date. Court documents state that but not the decree. I have heard it written many different ways. I have been promoted two times since the divorce and will be up for promotion again before retirement and have been in 5 more years. Why should she be entitled to the additional pay if we weren't married. Just so everyone knows, both of our lawyers claimed to be military specialists. Thats what 50K will get you these days..... Any help will be appreciated.

I was married for 17 and a half year to a service man. I have raised his 2 kids and yes he did pay his child support. But he retired over a year ago and I cant seem to get any of the retirement that was awarded to me. I dont know what to do any more I have no money to fight him again.

look up the DFAS guide for Dividing Military Retiements

read it and you will be able to pick a good formula AND get a good lawyer--I didn't and had to pay the price in the long run
