Divorce in FL - how is it all divided?
      #606972 - 12/03/09 07:24 AM

Married 24 years, stayed at home to raise 2 children, now 17 and 15. own home that has likely no equity due to the real estate market. Own 2 smaller homes that are rentals, may have 10k equity in each. How is the alimony/child support determined? If I can't afford to stay in my home, is my ex going to be asked to pay the mortgage? He's no longer "in love" = emotional affair. Just went back to work making very little money and really don't want to make our kids move.

I doubt you'll be able to have your ex pay for the mortgage, however if you are determined eligible for alimony, it can certainly assist you in paying that mortgage. It stinks that after 24 years you can't work it out, but life post divorce leads to many changes, one of them might be your living situation.

CS determined using ratio of income. So you + him = XX. XX will provide a $$ of support for two children. Your ratio of income to the total income will determine a percentage that each parent is responsible for. That will determine CS.

Alimony will be determined separately. I'm sorry I can't offer anything for you there.

As far as your home and rental properties, you will determine in your separation of assets who gets the rental property and the value will be included in that parties assets. If you give him the property, it's possible you can get a monetary settlement that can assist in keeping your home.

Your CS will likely end at 18 for child #1 unless that child will graduate at 19. It's typically 18 or graduation, whichever comes last.
