I live in Illinois and got married in 2003. We have no children and the only thing in both of our names is an SUV. I have had no contact with my husband in almost 3 years and the reason I have not gotten a divorce is because I am afraid that he would want possession of my truck. I have made every payment on that vehicle myself with absolutely no help from him since the day I bought it. I am now 9 months away from paying it off completely. What happens at that point? Let's say I get a divorce now, before it's paid off, can he come around and say he wants the vehicle and be awarded it? This is the only thing stopping me from getting rid of this person from my life and getting my last name back.

i'd do the divorce and not worry about the truck. that's the least of your problems.

If you can prove that you are the one paying for it it is unlikely that he can claim it.

Is Illinois a community property state?
what does he drive?
Does either of you have a 401k?
any joint accounts?
etc etc etc???
