Married 2003, no children, my husband walked out on me in early 2008 to be with his girlfriend. Did not tell me where he was or that he wasn't coming back until early 2009.
Continues to pay me $7000p/mth SS (which he brought down from original payment of $10,000p/mth upon initial seperation.
I married him age 22 & have not worked throughout the duration of marriage but am a full-time student.
He now wants to get divorced.
What are my rights in NYC? Will my SS continue? Should I ask for a settlement? I am worried about loosing my private health insurance if we get divorced. Does the abandonment count for anything?

I'm paying for it now out of the SS. I only just started. The amount of ss obviously is relative to his income.

So, how long do you think you should GET his amount, and what did you do for him that makes you WORTH that much?

I don't want to get into a philosophical debate. My husband had multiple affairs and then eventually left me for another woman, refusing to tell me this for over a year. I tried desperately to save the marriage. I just wanted to know if I had any legal rights.

And you DO have legal rights, but your marriage does not rise to the level of "long term", and while you MIGHT get a LITTLE alimony, you won;t get much and not for long.
Youhave a right to half of the assets aquired during the length f the marriage, and NOTHING more.

OMG, You hit that on the nose. You shouldn't get anything for a 5 year marriage except Child Support. But there is no children. duh... Spousal support is out of the question. Something isn't adding up though if she is getting SS. Maybe a lie.... ????????

And YOU shouldn't presume to know that spousal support is out of the question for this poster or suggest that she is lying. Maybe her husband is a millionare who would not let her work outside the home. Maybe she had to maintain his business at home and entertain business guests and run charitable groups for him.
