Show up at out of state settlement conference?
      #637407 - 02/28/10 10:25 AM

Long marriage 20yrs. Long divorce. Big dif. in income Me 20K 58 years old He 110K 55 years. No custody issues. community prop state. House sold proceeds already divided. Only issues now are permanent alimony, duration of alimony, division of investments (50/50) and a math problem about who withdrew what from a joint account. Q something already attached to his pension.
My attorney withdrew last month after 3 years due to health. I have a brand new attorney who I have never met.
Just talked on phone and email. He is Wise old sod who has heard it all and seen it all in 30 years of practice.
settlement coference and pre trail conference and trial date just have been set. Settlement conference 6 weeks away and my attorney has been representing me for 3 weeks!!!Trial date 2.5 months away.
At first my attorney said show up for the settlement conference 3000 miles away. Now he is saying I can do it by phone-- be available by the phone at the time of the settlement conference Would it be to my advantage to be at the settlement conference with the Judge, each of our attorneys.??? My soon to be ex is also an attorney so I would be the only person in the room without a law degree.
I realy really dont want this thing to go to trial because it would be a massive waste of money.
Do clients say anything to the Judge in a settlement conference or do they just shut up and let the attorneys represent them. ??
I will have to pay about $1500 to go out for the settlement conference (airfare, hotel, car) refundable airline ticket.
I am not sure what to do.
Also I gave instruction to my attorney to try to settle the divorce BEFORE the settlement conference to avoid court cost but I am not sure it will settle as my stbx is even slow to respond to his own attorney.
Divorce has cost me 42K so far ( lots of motions, stipulations, vocational evalauation from opposing counsel)
I am asking for partial payment of my attorneys fees. They may fight that. Voc. evaluation said I was fully employed.
