So here goes. I hired a lawyer that came recommended to me by my sister and who her boss also used and loved. But i was starting to worry as its been two weeks since i gave her the paper work to start my divorce petition. Iv been patient and given her space but am ready to start hounding her. On top of that i found some unhappy reports on her by previous ppl about not doing the work as she should, but again have heard equal amounts of good things. Im afraid i might be one of the ones she screwing over. My question is, how long to draft these docs. Am i wrong thinking she should have called me needing something i forgot or have them drafted for review by now?? How long should this take?

Lawyers take on more cases than they can handle so EVERYTHING takes longer. Still, two weeks to even start a divorce petition is too long. What worked for me is I would schedule a 15 minute appointment and then cover all of my issues in that time. (Lawyers bill in 15 minute increments so you may as well get as much discussed in 15 minutes as possible. Keep a timer nearby.) When you have your appointment, don't engage in any small talk that could get your lawyer diverted from the subject. Ask for a deadline to have the papers created, for you to review them and then have them delivered. If the deadlines are not met, call and POLITELY ask when they will be created/delivered, etc. And then call every day that they are late.
That's how I would manage it.

Thanks, i thought so too... Update: i called and was told she had surgery last week.. hmmm.. Not that it might not be true but sounds like the bull she has given others.. We will see. Im going to ask for a specific date to come in and go over them so maybe that will get the ball rolling. Anybody else have input here? How long did it take for yout lawyer to draft and or file your petition?

Well I feel better now (I know this does not help you but..) I was getting frustrated waiting a day to hear back from my lawyer! She has had my paperwork for three business days now and has told me today that the papers will be submitted tomorrow.. at the one week mark I would have freaked out.

Well it has now been a month, a few days over actually and she still has not even filed my paper work!! What can i do, its a non refundable retainer. Is there some statute on them filing i can claim?

Did you ever schedule a meeting with the lawyer to figure out what is going on or to move it forward?
You can always demand your money back or threaten a compllaint to the Lawyer's Board of Ethics in your state.

This is the email i sent last night and the attorney is pissed at me. Saying she only got the address to file on him x amount of days ago.. well she only got it then cause she didnt even have the paper work done yet!! And for her to be mad? I believe i was more then polite in this letter. Reporting her will really only punish her at best and ill never see my retainer again.
I am writing in regards to my case. When I last spoke with you March 9th, we made plans for me to email XXX's address to you and remind you to email me my Settlement Agreement for review March 12th. I did what was asked of me. I never received my final judgment that Friday as agreed. I was informed by Michelle it would be here today March 15th and have yet to receive anything. I hired you on Feb 9th and faxed the required documents to you on Feb 12th. I feel as though a month to file a divorce petition is to long. In my experience as a legal secratery, I have never had my attorney take this long to file a divorce. I feel that i have been more then paitent with regards to this matter, as I understand that attorneys can get swamped with too many cases. I hired you because you came with very good reviews from a few people I know and even the last attorney I worked with. I would like for us to work together under this assumption and have you by my side. If you feel that you cannot represent me to your fullest and in a timely manner as promised then I respectfully ask that we work out a way to refund my non-refundable retainer. Please understand my husband is due to be in the states any time now and I still have absolutely nothing filed, no temporary custody, nothing to protect me and my child and that is very scary and I depend on you to do this for me. This man has put numerous holes in my walls, called me terriable names in front of my child, locked us both outside by nailing the door shut and even went as far as to hide my son from me at someone elses house one morning while i was sleeping for leverage for me to move out. I need this paper work done quickly to protect me from this. So can we please work on getting this done in a timely and ethical manner, or consider a refund so i can find another means of protecting me and my son. I'd appreciate your responce in this matter, and where we should go from here.

Well i went to her office Wed after i still had no papers. She promised that this should be done Fri. I doubt i will get anything... Is there anything i can do to get my money back. I know she wont do it willfully.

Update: I hired this women Feb 7. As of today she still has not filed my paperwork with the clerk of courts and has now sent me a bill. Its bad enough to go threw divorce but now i have to battle her too?
