I will try to just give the facts here and am looking for options that I have. Wife and I have been married almost 9 years with 3 kids. She is seeking a divorce ... I have suggested Marriage counseling, Religious leader help, etc. but nothing is taking.
I have 6 neighbors in our neighborhood who I know would be willing to come forward about parental neglect on her part (they were close to calling the police while I was deployed 2 months ago). No history of adultery. She has no college education and has not worked since we've been married, but not due to my job - she chose to stay at home. I am AD Air Force and deploy on average once every year for 4 months. Do I have a shot at full custody? - I'm not concerned about alimony, etc right now...just my chances at full custody.

My husband is a custodial parent ADAF and I can think of at least three others in my neighborhood alone.
but if you are gone 40% of the year every year I don't know how you would be able to do it. You can ask for full custody but be willing to settle for 50/50 placement. I would worry about keeping your kids in your area versus moving out of state.
Where are you.

Stationed in FL ... will be PCSing soon to NM. Misunderstanding on the deployment rate...gone for 4 months and then home for a year, but they will become significantally less with my next move.
I am fine with the children staying with her during deployments, but will the evidence of parental neglect be enough for the court to grant me custody? And does my status as an ADAF member, who has the possibility of deploying, make it less likely that the court will make me the custodial parent?
Also, if there is no shot at full custody, what kind of chance is there at a court mandate that she move into the same state I am stationed at? -thx

A court cannot mandate she move. I will state this though, my husband got custody in NM. NM is very pro 50/50 and has been since the 90s when I divorced.
I have no really heard good things about FL.
Do you have an attorney?
