My son has a 6 month old daughter, that was born in Dallas, Tx. He and the mother stayed together for 11 months and were never married. The father has never been able to spend any quality time with his daughter, because of the mother. She uses the baby to get to the father. Right now she has moved out of state and refuses to let the father pick the baby up even for the weekend. The first time the mother left with the baby my son told me "that she (the baby) was why he woke up, why he went to work, why he smiled and that everything he did was for her". He's really confused and hurt but he's a soldier. What rights do he have and what can he do?

Can't your son file for a custody hearing? did they live together, cus if so in the state of Tx they are legally married by common law.
