X says that's her right because she is CP and her accountant backs her up but her lawyer told her to give me the exemption. My lawyer told me if we take this to court I will win and make my X look like she's vindictive! Her lawyer never put it in the decree that she gets to claim the exemption for my younger son, my lawyer wouldn't allow it. X says IRS law says the exemption goes to CP! She thinks I forged her name to the 8332 form!

She is correct.

So?

Your lawyer is wrong.

It doesn't need to go in the decree. She is the CP.

X says IRS law says the exemption goes to CP!
Again, she is correct.

Did you?

X said I will wind up paying the penalties for claiming my son when the IRS pulls both returns and realizes we both claimed my son.

Actually, in mine, the CO (via the judge) decided who claimed who. It wasn't a long time. Just a couple of years. It was after her alimony stopped (which we agreed she would get them to offset her being taxed on the alimony). Once it stopped, the kids were split. Only lasted 3-4 years.

You only think the CO decided. Had you claimed them and she didn't or vice versa, everything would have gone perfectly smooth.

According to my X's lawyer...CO's are just a piece of paper...no big deal!

Apparently that is primarily true of your attorney's law degree.
