I am presently heading for a divorce after less than 2 years and have a question about what my wife may be able to claim in the divorce. I bought my house in 2002 and it is in my name only. I married my wife in 2004 and refinanced the house in Oct 2005. When I refinanced, I was told that her name had to be on the loan also because of state law concerning dowry rights. My question is: Is she entitled to half of the equity from 2004 or from Oct 2005? Plus, how does the fact that the title/deed is recorded as in my name only? Thank you for any help,

Hey Cinder,

Thank you for the website. Another question for you: If she is entitled to half of the equity that has built up in 1 yr and 10 months, then how do they determine how much equity that is? Wouldn't they have to know what the house was worth right before we got married to be able to determine the difference in that amount and what it would be appraised at now? Plus, the site that you sent me to said that if the houses value is increased by one or the other exclusively, then the one that didn't contribute is not entitled to that amount that raised the price of the home. Something like that anyway. Thanks for any answers.
