Wife left the state with my son
      #684058 - 08/21/10 08:36 AM

My wife, our son (4yrs old) and I moved from Austin to Atlanta 3 months ago. We've been renting a house in Atlanta for about a month and a half (signed a 1 yr lease). Last week she moved out of the house with my son. She took all her things, and about 1/2 of our furniture, decorations, etc. Yesterday, while I was at work, I got a text message from her saying she was on her way back to Austin to get a Child Support order, and to find a place to live.

I'm pretty upset. 2 days after she left the house, I gave her $500 in cash, and the use of the only car we have (for my son's sake). The day after that, I deposited another $500 into her bank account. We had an agreement that I would give her $1250 per month in child support, and had tried repeatedly to work with her on getting her a place to live (offering her the house to live at, offering to sign a lease for her on an apartment, etc). She doesn't work, and currently relies on my income for support (which is why I immediately gave her $1000 when she left). Keep in mind that she left me.

In Georgia, we cannot file for divorce until we have lived here for 6 months. But, we've already have been out of Texas for 3 months. Obviously, I am against her moving my son back to Texas. We've lived there for only 3 years, neither of us have any family there and she never had a job there. So neither of us have any roots in Austin. On the other hand, we do have roots in Atlanta. first of all, we live here. My job is here. My wife has family and friends here (we met and were married in Atlanta, and lived here for about 4 years before we moved to Austin).

I've contacted the police here. There's nothing they can do because there's no court order. I've contacted a lawyer here in Atlanta, and it seems that anything I file here can be dismissed by her, since we don't yet meet the residency requirements to file. Now I need to contact a lawyer in Austin. But it's Saturday, and my fear is she signs a lease in Austin in the next few days. Once she does, will it be too late to get my son back to Atlanta? I've just went from seeing my son everyday to having no idea when I will see him again.
